- Scope of Application of FIKRI A BAKER Terms.
A. Fikri A Baker Blog Terms. The following terms and conditions ("Terms") apply to all users (“Users”) who access and use the Blogger.com or blogspot.com (“Blog”) operated by fikriabaker.blogspot.com., in Indonesia and provided by Fikri A Baker. Inc. On Blog sites. This Blog is not limited to pages, advertising, postings and related information and any associated services provided by fikriabaker.blogspot.com (collectively "Blog Services”).
B. Conflict with Terms of Blog Site. If any of the Terms stated here conflict with the terms and policies imposed by any Blog sites on which Fikri A Baker has provided the Services, then such Blog site’s terms and policies control.
- Responsibilities of Users.
A. At its sole discretion, Fikri A Baker reserves the right to remove any content posted on a the Blog where Services are provided, if it determines that the content violates any of the provisions listed in Part B following.
B. User agrees that it shall not use the Fikri A Baker Services to:
- Intentionally or unintentionally use any part of the Services in a manner contrary to or in violation of any applicable international, state, or law, rule, or regulation having the force of law;
- Defame or libel any person, other Users, and other third parties, and their products and service.
- Post offensive or illegal materials or statements about other Users or other third parties, or post materials or statements that would damage the reputation and/or credibility of Fikri A Baker Inc.
- Invade the privacy of any person, including other Users or other third parties by posting or distributing such person's personal information including but not limited to such person's telephone number, residential or business address, and email address.
- Launch, organize or promote directly or indirectly any nomination or election of a political candidate, party, or campaign, or advocate for a political issue or position.
- Disseminate the philosophy of, advocate for or solicit membership in any religion, or religious organization, club or any other similar entity.
- Reproduce, duplicate,copy, download, distribute, publish, broadcast, sell, resell, use or otherwise exploit the Fikri A Baker Services, or any portion thereof, for personal reasons, except as permitted under applicable state law within Republic of Indonesia.
- Reproduce, duplicate, copy, download, distribute, publish, broadcast, sell, resell, use or otherwise exploit Fikri A Baker Services, or any portion thereof, for commercial purposes.
- Harm, infect, take over, disable, overburden, or otherwise impair any part of the Services, including, but not limited to, the servers, networks, and other components connected to or used for the Fikri A Baker Services.
- Interfere with any other User's use of or access to Fikri A Baker Services, or any portion thereof.
- Upload or otherwise transmit any content to Fikri A Baker Services that User does not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
- Upload or otherwise transmit any material to Fikri A Baker Services that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
- Attempt to gain unauthorized access to any services, accounts, computer systems, or networks connected to any server used for Fikri A Baker Services, through password mining, hacking, or any other means.
- Seek to gain access to any materials or information through any means not intentionally made available by Fikri A Baker.
- Make any use of Fikri A Baker's copyrights, trademarks, service marks, trade names, logos, and graphics on Fikri A Baker Services, without Fikri A Baker's prior written consent.
- Use any network monitoring or discovery software to determine the site architecture, or extract information about usage, individual identities, or Users of Fikri A Baker Service.
- Use any robot, spider, other automatic software or device, or manual process to monitor or copy Fikri A Baker Services or any portion thereof.
- Cause damage or loss to Fikri A Baker, other Users, or other third parties.
C. If, in using Fikri A Baker Services, a User breaches any one of the responsibilities listed in Part B above causing damage to another User or a third party, such User agrees to compensate such other party for any damages suffered and to resolve any dispute with the other party at their own expense and without involving Fikri A Baker.
D. If, in using Fikri A Baker Services, a User breaches any one of the responsibilities listed in Part A above causing damage to Fikri A Baker, such User agrees to compensate Fikri A Baker for any damages Fikri A Baker suffered.
- Disclaimer Regarding Fikri A Baker Services.
THE SERVICES, MATERIALS AND INFORMATION PROVIDED BY FIKRI A BAKER SERVICES ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH FIKRI A BAKER BLOG OR BLOG PAGES OR SERVICES AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY,COMPLETENESS, EXPECTATION OF PRIVACY OR NON-INFRINGEMENT. ALL SUCH WARRANTIES ARE EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL FIKRI A BAKER OR ANY THIRD PARTY PROVIDER BE LIABLE FOR ANY DIRECT OR INDIRECT INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO IN EACH CASE, LOST PROFITS OR SAVINGS), WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR IS IN ANY WAY CONNECTED WITH (i) ANY USE OF FIKRI A BAKER SERVICES OR CONTENT FOUND HEREIN, (ii) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO, THE USE OF OR INABILITY TO USE ANY COMPONENT OF FIKRI A BAKER SERVICES) OR INTERRUPTION OF USE OR CORRUPTION OF DATA (iii) THE PERFORMANCE OR NON PERFORMANCE, BY FIKRI A BAKER OR ANY THIRD PARTY, OR (iv) ANY MATTER BEYOND FIKRI A BAKER'S (OR ITS LICENSEES’ OR LICENSORS’) REASONABLE CONTROL, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- Intellectual Property Rights.
A. FIKRI A BAKER contents. The contents of the Blog and Services, including, but not limited to text, graphics, and icons provided by FIKRI A BAKER, are copyrighted materials owned or controlled by FIKRI A BAKER and contain FIKRI A BAKER's (and its licensees’ and licensors’) name, trademarks, service marks, and trade names. You may download one temporary copy of these materials on a single computer and print one copy of the materials for your use in learning about, evaluating, or acquiring FIKRI A BAKER's (or its licensees’ or licensors’) services or products. No other permission is granted to you to print, copy, reproduce, disassemble, distribute, transmit, upload, download, store, display in public, alter or modify these materials (except as permitted by law). FIKRI A BAKER assumes no responsibility for any other third party sites connected through its Services. FIKRI A BAKER assumes no responsibility for any other third party's site which hyperlinks to the FIKRI A BAKER Blog or Blog Pages or Services or any portion thereof.
B. User content. By posting content, information and materials that is subject to intellectual property rights (“IP Content”) to FIKRI A BAKER's Blog or Blog Pages when using FIKRI A BAKER Services, the User grants to FIKRI A BAKER, a non-exclusive, transferable, sub- licensable, royalty-free, worldwide license to use the IP Content and the User remains the owner of the IP Content. It is recommended that the User not reveal trade secrets or other confidential information in any IP Content posted on FIKRI A BAKER's Blog or Blog Pages.
- Governing Law and Venue.
Unless otherwise provided by law, these Terms and all claims or disputes arising out of or in connection with these Terms and your use of FIKRI A BAKER Services are governed by and construed in accordance with the laws of the State of The Republic of Indonesia without regard to conflict of laws principles. Any legal action brought against FIKRI A BAKER arising out of or in connection with these Terms and your use of our Website must be brought in a court of competent jurisdiction in the Supreme Court of the Republic of Indonesia, or the South Sumatera Province Court for the Palembang City, except for any legal action arising out of your use FIKRI A BAKER Services. This paragraph is not intended to add a choice-of-forum provision to FIKRI A BAKER’s Conditions based on your use of FIKRI A BAKER Services.
- Effective Date and Modifications to the Terms.
A. The Terms shall come into effect on January 1st, 2012.
B. FIKRI A BAKER may modify the Terms from time to time without User consent, and any modifications shall be in effect upon posting on FIKRI A BAKER's Blog.
